In episode 55 of GBAtemp’s Tempcast podcast, co-host and lawyer Eric Zander tried to explain why Take-Two filed lawsuit against the team involved in the re3 and reVC projects…
“Economic threat” from these projects
it can only be that “pirated” versions of games
appear, for example, on the Nintendo Switch,
but the company itself is to blame that so far
did not take a liking to this market – many large players
have long since released their flagship games on a handheld console.

According to Zander, either side can win the case. Take-2 has filed a civil lawsuit (in many respects this excludes the possibility of a prison sentence) and insists on a jury trial. Therefore, it all depends on how good the defending side’s lawyers are. The company wants to obtain an injunction against re3 and reVC, access all the download information and even all the files that the “reverse engineering” team (!) Worked on, as well as reimbursement of legal costs. Any verdict in this situation will create a precedent: mod creators will be able to calmly continue their business or will receive similar claims from other copyright holders.
