Nintendo of America and Teksystems Accused of Violating Unionization Rights in New Labor Complaint

  • A separate filing from December 9, 2025, brings forward additional accusations against Teksystems for similar breaches. Formal charges against the employers for both cases were finalized on January 7. While the granular details of the specific incidents are not yet public—which is typical for NLRB proceedings—neither Nintendo nor Teksystems has released an official comment regarding the litigation.

    This situation echoes a previous legal battle in 2022, where Nintendo and the staffing agency Aston Carter were accused of violating Section 8(a)(1) and Section 8(a)(3), the latter of which prohibits firing workers for union involvement. At the time, Nintendo maintained that the contractor in question was dismissed solely for leaking sensitive company data.

    That individual, game tester MacKenzie Clifton, later spoke to Axios, claiming their termination occurred shortly after they questioned the president of Nintendo of America about his perspective on labor unions. Clifton argued that the “confidential information” Nintendo cited was actually a lighthearted tweet regarding a minor glitch in game textures.

    The 2022 dispute concluded with Aston Carter paying Clifton nearly $26,000 in damages and back pay as part of a settlement. Consequently, Nintendo was required to display workplace notices explicitly informing employees of their legal rights under the National Labor Relations Act.
