Legal counsel for the corporation asserts that, since February 1, 2025, the Trump administration has been levying duties on importers based on “unlawful” executive mandates.
Nintendo, operating through its subsidiary Nintendo of America, has initiated litigation against the U.S. Department of the Treasury, the Department of Homeland Security, and U.S. Customs and Border Protection. The gaming giant is seeking the recovery of funds paid under tariffs established by President Donald Trump’s executive directives.
The complaint was filed in the U.S. Court of International Trade. Attorneys for the company argue that starting in February 2025, the administration began collecting duties on imported goods under “invalid” orders that imposed tariffs on a wide range of international trade partners.
According to Nintendo representatives, the company possesses the legal standing to sue as the official importer of record for the products impacted by these levies. The filings further state that the corporation has suffered direct financial injury as a consequence of these trade barriers.
Specifically, the litigation notes that in April 2025, Nintendo was forced to delay the launch of pre-orders for the Nintendo Switch 2. Furthermore, the company subsequently increased the retail prices of several accessories—a move directly attributed to the global tariffs enacted by the administration.
Nintendo’s legal team warns that without judicial intervention, the company faces “irreparable harm” unless the paid duties are reimbursed in full, including accrued interest.
The lawsuit emphasizes that even following a recent U.S. Supreme Court ruling that found the tariffs to be illegal, the restitution of funds to importers is not an automated process. Consequently, the company has been forced to seek compensation through the court system.
The situation is further complicated by the stance of U.S. Customs and Border Protection, which informed the court that it is currently unable to fulfill refund requests due to technical limitations within its systems.
