Last year Nintendo sued Jesse Keigin, known online as Every Game Guru, after he streamed at least ten unreleased Nintendo Switch titles beginning in 2022. The case concluded in the corporation’s favor, although the damages awarded could have been far greater.
The streamer sent letters to Nintendo’s headquarters boasting that he “had a thousand backup channels” and that he “could do this all day.” Those claims proved hollow, and the extra accounts offered no protection once the company’s lawyers intervened.
He destroyed evidence and avoided service, so court notices were sent to his grandmother, mother, and partner but went unanswered. Ultimately, a federal court in Colorado entered a default judgment: Keigin was ordered to pay $17,500 in damages for copyright infringement.
Nintendo also sought an order to destroy “all devices for circumventing protections,” but the court rejected that request as “vague” and “unwarranted,” citing the widespread availability of emulators.
The company could have pursued up to $100,000 — $10,000 for each game — but the award was limited to $10,000 for the most recent infringement and $7,500 for repeated circumvention.
